
Representative of an Overseas Business Visa

On 15 March 2022, the Home Office announced changes to the Immigration Rules for people coming to work in the UK. As a result, the Representative of an Overseas Business visa route will close to new applicants at 9am, 11 April 2022. Existing visa holders of this route will be able to extend their leave and apply for settlement as before.
As part of these changes, the Home Office announced the new Global Business Mobility visa, which will be open to applicants on 11 April 2022. It offers overseas companies five categories of sponsored routes to help them establish different types of presence in the UK. While the visa holder will have the right to visa extension, they will not be able to apply to settle in the UK. Instead, they may consider switching into other routes that lead to settlement, such as Innovator visa and Skilled Worker visa.

Summary
In order to qualify for a Representative of an Overseas Business visa (commonly known as Sole Representative visa), you will need to satisfy UK Visas and Immigration that your overseas company:

is a genuine, trading business;

has no branch, subsidiary or other representative in the UK;

intends to establish a branch or subsidiary in the UK, operating in the same type of business as the overseas business;

intends to maintain the centre of its operations overseas.
You will also need to demonstrate that you:

are a senior employee in the business;

have been recruited outside of the UK;
-
have full authority to take operational decisions on behalf of the business;

do not hold more than 50% of the shares in the business;

do not intend to take employment other than for your business;

are competent in the English language to at least CEFR Level A1 (speaking and listening);

can maintain and accommodate yourself and your dependants.
Provided that you meet the below requirements, you will be granted residency for an initial period of 3 years.
